NSW Fair Trading swoops on state’s RV dealers

NSW Fair Trading has announced the result of their compliance operation into the NSW Caravan and Motorhome industry and the results were made announced on their Facebook page today.

Out of 57 dealers inspected, 16 were non-compliant with the legislation; 32 disciplinary actions also resulted.

A spokesperson for NSW Fair Trading told RV Daily they had issued 16 Penalty Infringement Notices (PINS) and five official warning letters. A further 11 rectification inspection reports were issued for minor breaches of the legislation.

“This was a proactive educational compliance operation, not an investigation. We work with traders to ensure they understand their obligations under the legislation and take an educational approach to minor breaches of the legislation. If any serious breaches are discovered during these activities, they are referred through for further investigation.”

When asked about naming the non-compliant businesses, the spokesperson said, “Fair Trading does not release the names of non-compliant businesses in any operation until such time as they have had procedural fairness to respond to allegations (warnings), or seek a review of PINs or indeed a request for the matter to be heard in a Court of Law.”

The specific non-compliance issues identified were:
• Incomplete Form 1 Police books
• Incomplete Form 5 and 9 Dealer Notices (missing consumer acknowledgement signatures and RMS inspection report details)
• Repairers not keep/maintain Form 4 Prescribed Parts Register
• Licence signage

While the issues were largely administrative in nature, it does show that NSW Fair Trading is ensuring RV dealers in NSW adhere to their compliance responsibilities and work to maintain consumer confidence.

It will be interesting to see if any other state governments take similar action.
